Dr. Hassan Wirajuda ketika sebagai Menteri Luar Negeri
RI memberi Keynote Speech dalam
Seminar peringatan Perjanjian Linggarjati
di Kuningan pada 11 November 2006. Dia mengatakan a.l.:
"… Kemerdekaan
dimungkinkan dalam pengertian hak menentukan nasib sendiri apabila demand metropolitan powers, negara
penjajah dapat menyetujui, by agreement,
sesuatu yang merupakan akibat dari kesepakatan, bukan merupakan hak, tetapi
produk dari perundingan, kalau pihak yang lain tidak setuju, maka kemerdekaan
itu tidak akan ada …
… saya sering
mempertanyakan setiap tanggal 17 Agustus dibacakan naskah proklamasi. Kita
memaknai kami bangsa indonesia dengan ini menyatakan dengan ini kemerdekaannya,
pertanyaan saya tadi, apakah bisa? Seperti yang saudara telah ketahui, tidak
bisa sebenarnya, menurut tatanan dunia internasional pada saat itu…”
Dengan kata
lain:”Proklamasi Kemerdekaan Indonesia 17 Agustus 1945 TIDAK SAH, karena negara
penjajah TIDAK SETUJU!

Tahun Perundingan Linggarjati

Deplu bekerja sama dengan Pemerintah Kabupaten
Kuningan, menyelenggarakan Seminar Nasional Peran Diplomasi dalam Perjuangan
Bangsa dengan tema “Reaksentuasi Kekuatan Diplomasi, Sebuah Refleksi Sejarah
Perundingan Linggarjati” pada tanggal 11 November 2006 di Kabupaten Kuningan.
Seminar yang didahului oleh upacara peringatan 60 tahun Perundingan Linggajati
di Museum Perundingan Linggarjati, Kuningan, yang direncanakan akan dibuka oleh
Menteri Luar Negeri dengan narasumber Prof. Dr. Rosihan Anwar, Duta Besar Nana
S. Sutresna, Prof. Dr. Anhar Gonggong, dan Prof Dr. Leirissa.
Dalam kesempatan ini juga akan diluncurkan buku Museum
Perundingan Linggarjati sebagai suatu bentuk kepedulian Departemen Luar Negeri
dalam melestarikan bangunan bersejarah yang mengandung nilai-nilai perjuangan
bangsa khususnya melalui jalur Diplomasi.
Perundingan Linggarjati merupakan tonggak sejarah yang
sangat penting karena pada perundingan tersebut secara de facto eksistensi RI
diakui oleh Belanda yang untuk pertama kalinya mau duduk berunding sejajar
dengan Pemerintah Indonesia. Selain itu, perjuangan diplomasi Indonesia melalui
Perundingan Linggarjati menunjukkan bahwa keterpaduan antara perjuangan fisik
dan diplomasi telah membuahkan hasil pengakuan dunia internasional terhadap
kemerdekaan Indonesia, sekaligus menjadi sumbangsih bangsa Indonesia bagi
perubahan mendasar tata dunia ketika itu yang tidak mengakui kemerdekaan suatu
negara sebagai hak namun diberikan bila mendapat persetujuan dari negara
penjajahnya.
Perundingan Linggarjati juga merupakan simbol tekad
dan kemampuan bangsa Indonesia untuk menyelesaikan konflik dengan cara-cara
damai melalui dua kekuatan bangsa, yaitu kekuatan moderasi dan kekuatan dialog.
Kekuatan moderasi sebagai karakter alamiah Indonesia sebagai bangsa yang
moderat merupakan keyakinan akan kebenaran prinsip-prinsip yang dianut oleh
Indonesia tanpa meniadakan sikap toleransi terhadap prinsip dan kepentingan
pihak lain. (DIPLIK)
Seminar Nasional pada tanggal 11-12 November 2006
Press Briefing kali ini dimulai dengan penyampaian
mengenai penyelenggaraan seminar nasional tentang peran diplomasi dalam
perjuangan bangsa dengan tema ”Reaksentuasi Kekuatan Diplomasi: Sebuah Refleksi
Sejarah, Perundingan Linggarjati”, yang akan berlangsung pada tanggal 11-12
November 2006 di Hotel Grage Sangkan Linggarjati, Kuningan. Seminar ini
dihadiri oleh Menlu RI dan sejumlah narasumber, yaitu antara lain Rosihan
Anwar, Nana Sutresna, dan Anhar Gonggong.
Jubir menyampaikan lebih lanjut bahwa tujuan dari pelaksanaan seminar
ini adalah juga dalam rangka melestarikan bangunan sejarah yang mengandung
nilai-nilai perjuangan bangsa, khususnya melalui cara diplomasi.

Yang saya hormati Bupati Kuningan, Bpk. Aang Hamid
Suganda,
Yang Mulia Bapak Duta Besar Belanda, Nikolaos Van Dam
Yang saya hormati Bapak Duta Besar Nana S. Sutresna,
Yang Saya Hormati Bapak Rosihan Anwar, dan Hadirin
Sekalian,
Assalamualaikum Warahmatullahi Wabarakatuh,
Selamat Pagi, dan Salam sejahtera bagi kita semua,
Sungguh suatu hal yang menggembirakan ketika saya
mendengar bahwa Pemerintah Kabupaten Kuningan bermaksud memperingati 60 tahun
Perundingan Linggarjati. Inisiatif yang
berasal dari Pemerintah Daerah ini merupakan salah satu bentuk penghargaan
terhadap perjuangan diplomasi Bangsa Indonesia. Lebih dari itu, inisiatif ini
mencerminkan kesadaran akan potensi yang dimiliki Kabupaten Kuningan, sekaligus
keinginan untuk memanfaatkan potensi itu untuk kebaikan bersama.
Kita terkadang lupa untuk melihat potensi yang kita
miliki; sebaliknya kita justru melihat apa yang TIDAK kita miliki, atau apa
yang dimiliki orang lain.
Sejarah bangsa kita adalah milik kita bersama. Tugas
kita bersama adalah memelihara kebenaran sejarah dan belajar dari nilai-nilai
dan pengalaman bersama yang terkandung didalamnya. Periode tahun 1945 sampai
dengan 1950 merupakan bagian terpenting dalam sejarah perjuangan bangsa. Karena
kurun waktu itu merupakan periode pembentukan karakter dasar negara dan bangsa
Indonesia, atau disebut sebagai “the
formative years”, masa-masa pembentukan, seperti halnya kehidupan manusia,
masa lima tahun pertama merupakan masa sangat indah dan berpengaruh dalam
kehidupan seorang manusia.
Saya menganggap penting pemahaman yang baik, sungguh
lebih baik oleh kita semua terhadap sejarah perjuangan bangsa periode
1945-1950. Sebagai seorang yang tidak mengalami babakan sejarah masa itu, saya
memberikan perhatian penting termasuk dalam studi saya, saya melakukan
penelitian dan menulis master thesis saya, ketika saya belajar di Amerika
Serikat yang berjudul The Indonesian
Questions and the Security Councils.
Bangsa Indonesia memiliki banyak pemikir dan negarawan
besar dalam masa pembentukan itu. Mereka
adalah para pendiri bangsa yang mempunyai visi bagi masa depan bangsa,
sekaligus tekad untuk mewujudkannya. Ruh
dan semangat juang itulah yang harus kita warisi sebagai inspirasi bagi upaya
kita bersama mewujudkan masa depan yang lebih baik.
Sebagai salah satu rangkaian peringatan 60 Tahun
Perundingan Linggarjati, pada seminar ini saya ingin mengajak kita semua untuk
melakukan refleksi, renungan tentang jati diri bangsa Indonesia. Apa alasan mendasar, “raison d’etre” dari
negara ini dan apa potensi yang kita miliki? Apa sumbangsih yang bisa kita
berikan sebagai bangsa kepada dunia?
Sejarah Indonesia di awal perjuangan menegakkan
kemerdekaan menunjukkan bahwa perjuangan diplomasi memainkan peranan yang signifikan. Terus terang dari penelitian saya, khususnya
pada periode sejarah ‘45-‘50 ini, saya melihat kurangnya apresiasi atau
penghargaan bangsa terhadap peran diplomasi. Kalau dalam upaya menegakkan
kemerdekaan (pandangan ini berarti bahwa Indonesia belum merdeka pada 17.8.1945 –
BRH) kita mengkombinasikan, memadukan perjuangan fisik dan diplomasi,
memang yang lebih membekas, berkesan, yang diberikan apresiasi yang sifatnya
lebih banyak pada perjuangan fisik, oleh karena itu tidak banyak nama jalan
yang diberikan kepada para pendahulu republik ini yang justru memberikan
kontribusi yang penting dalam menegakkan kemerdekaan bangsa.
Kalau kita menyelami apa yang terjadi pada babakan
sejarah pada waktu itu. Saya tadi menyatakan, dalam pidato saya sebelumnya,
memang kita berhadapan dengan Belanda, tetapi sesungguhnya kita berhadapan
dengan dunia,
(BRH:
Dunia yang mana? Di PBB mayoritas adalah Negara negara dunia ke-3 dan
Negara-negara blok komunis yang menentang imperialisme dan kolonialisme)
bayangkan pada waktu itu proklamator kita dengan lantang menyatakan “Kami
Bangsa Indonesia dengan ini menyatakan kemerdekaan Indonesia” demikian juga
dalam pembukaan Undang-Undang Dasar, yang menyatakan bahwa “kemerdekaan itu
adalah hak segala bangsa” dapat kita pertanyakan apakah kemerdekaan itu dapat
dinyatakan?
(BRH:
Jelas dapat! Lihat pernyataan kemerdekaan Belanda, USA, negara-negara Amerika
Selatan, dll., yang memisahkan diri dari negara-negara penjajahnya.)
Saya yakin 100% bapak-bapak dan ibu-ibu mengatakan iya, tetapi mudah mengatakan
sekarang, tetapi 60 tahun lalu tidak demikian , mengapa?
Karena tatanan dunia atau
international order yang berlaku setelah
berakhirnya perang dunia kedua yang direfleksikan dalam piagam PBB, atau UN
Charter, berbeda dengan tatanan nasional kita yang kita cerminkan dalam UUD
1945, mempunyai konsepsi yang tidak hanya berbeda, tetapi bertolak belakang.
Yang saya maksud adalah bahwa dalam piagam PBB Prinsip hak menentukan nasib
sendiri atau “self-determination”
dalam tidak dimaksudkan sebagai hak suatu bangsa terjajah untuk merdeka. Saya
mendalami bagaimana proses perundingan di San Fransisco.
(BRH: Ngawur sekali! Wirayuda tidak
mengikuti proses terciptanya kalimat “right for self determination of peoples
dari tahun 1896, kemudian pernyataan Woodrow Wilson tahun 1918 dan Atlantic
Charter 14 Agustus 1941 serta pernyataan Ratu Belanda Wilhelmina di London pada
7 Desember 1942)
Kebetulan bersamaan waktunya ketika PPKI (Panitia
Persiapan Kemerdekaan Indonesia) antara periode bulan mei-agustus, merancang
UUD 45 Ingat piagam jakarta, kecuali tujuh kata yang kemudian dihapuskan yang
lalu menjadi pembukaan UUD 45 pada tanggal 22 juni 1945 sudah sangat jelas
memuat kalimat pertama yang menegaskan Kemerdekaan sebagai hak suatu bangsa. Tetapi
di San Fransisco, dalam perundingan tentang Piagam PBB disana disepakati bahwa
dengan hak menentukan nasib sendiri dimaksudkan tidak lebih sebagai self rule, dan itu belum
merdeka.
(BRH: Wirajuda harus menunjukkan, di mana tertera “kesepakatan” tersebut.
Apakah Negara-negara di PBB begitu bodoh untuk menyatakan, bahwa self rule itu
artinya belum merdeka?!)
Kemerdekaan dimungkinkan dalam
pengertian hak menentukan nasib sendiri apabila demand metropolitan powers, negara penjajah dapat menyetujui, by agreement, sesuatu yang merupakan
akibat dari kesepakatan, bukan merupakan hak, tetapi produk dari perundingan,
kalau pihak yang lain tidak setuju, maka kemerdekaan itu tidak akan ada.
(BRH: Wirajuda
juga tidak mengetahui, bahwa kemerdekaan Belanda, Amerika Serikat, dll.,tidak
tergantung dari pengakuan negara-negara mantan penjajah. Lihat antara lain
Konvensi Montevideo 26 Desember 1933).
Oleh sebab itu, ini yang harus kita pahami beratnya
perjuangan diplomasi pada masa itu, bahwa yang kita tentang pemerintah kolonial
Belanda, ya tetapi juga tatanan dunia (BRH: Telah disebutkan di atas, DUNIA YANG
MANA?). Kenapa konsepsi ini tidak memaknai hak kemerdekaan? Karena kita
tahu bahwa yang menjadi negara-negara anggota dalam perundingan itu sebagian
besar adalah negara eropa, dan kita tahu sebagian besar negara eropa mempunyai
negara jajahan (hanya 7 Negara dari 32 negara di Eropa. Juga hanya negara-negara Eropa
Barat, sedangkan Negara-negara Eropa Timur tidak ada yang mempunyai jajahan,
bahkan menentang kolonialisme!). Ada dua negara yang waktu itu
mendukung konsepsi self determination
sebagai hak untuk merdeka adalah AS dan Australia (Bukan hanya dua, Uni Soviet,
Ukraina, Argentina, dll., juga mendukung kemerdekaan Negara-negara terjajah).
Karena itulah dalam proses diplomasi kita menggalang pengakuan internasional, recognition akan kemerdekaan yang
diproklamirkan pada 17 Agustus tahun 1945 itu adalah perjuangan yang tidak
mudah.
Dengan kata lain, yang kita saksikan di tanah air,
pada saat periode ‘45-‘50, katakanlah sampai dengan 27 Desember tahun 1949,
peperangan bentrokan fisik sebetulnya merupakan semburan api dari benturan dua
tatanan, tatanan nasional kita, berdasarkan UUD 45, dan tatanan dunia
berdasarkan Piagam PBB yang pada saat itu belum mengakui hak kemerdekaan bangsa
terjajah untuk merdeka. (BRH: Pernyataan yang luar biasa ngawur dan
sangat menyesatkan, karena tidak menggambarkan situasi yang sebenarnya. Di sini
digambarkan, seolah-olah membenturkan
Republik Indonesia sebagai satu-satunya bangsa dan Negara di dunia, melawan
SELURUH DUNIA!)
Ketika kita diterima sebagai anggota PBB pada tahun
1950, apa yang kita yakini, kita tuangkan dalam UUD 45, kita nyatakan dalam
proklamasi kita, kita perjuangkan, dan diterima sebagai konsep internasional.
Melalui komite dekolonisasi, dimana kita menjadi salah satu pelopornya, melalui
penyelenggaraan Konferensi Asia Afrika pada tanggal 23 april 1955, maka baru
pada tahun 1960, melalui resolusi PBB, untuk pertama kali diakui, all peoples have the rights to self determinations,
in their virtue of their pride they shall determine their own political,
economic and social system. ini dimuat dalam resolusi 1514 tahun 1960, yang
berjudul pemberian kemerdekaan bagi bangsa-bangsa terjajah.
Jadi sekitar 15 tahun sejak PBB didirikan, baru tiba
pada tahun 60 tentang hak bangsa terjajah merdeka, sesuatu yang telah menjadi
keyakinan penuh pemimpin bangsa kita sejak jaman dahulu, bahwa kemerdekaan
memang merupakan hak bangsa-bangsa, hal ini menjadi solidaritas bangsa-bangsa
Asia Afrika, maka pada periode itu seterusnya pada tahun 60-an lahirlah
bangsa-bangsa Asia Afrika yang merdeka. Coba bayangkan, perjuangkan kita untuk
kita sendiri, memperoleh pengakuan hak kita sendiri, tetapi kita juga
memperjuangkan hak-hak bangsa terjajah lain, umumnya di Asia dan di Afrika
untuk merdeka. Mungkin ketika disampaikan baru kita menghargai bagaimana
besaran konsep para pemimpin negara kita waktu itu, saya sering mempertanyakan setiap tanggal 17 Agustus dibacakan naskah
proklamasi. Kita memaknai kami bangsa indonesia dengan ini menyatakan dengan
ini kemerdekaannya, pertanyaan saya tadi, apakah bisa? Seperti yang saudara
telah ketahui, tidak bisa sebenarnya, menurut tatanan dunia
internasional pada saat itu.
(BRH: Sungguh luar biasa pernyataan Menteri Luar Negeri Republik Indonesia,
yang terkesan ingin menyenangkan hati Duta Besar Belanda yang hadir. Dengan
demikian, Wirajuda membenarkan “aksi polisional” Belanda untuk membasmi para
perusuh, perampok, pengacau keamanan dan ekstremis yang dipersenjatai oleh
Jepang, yang untuk bangsa Indonesia adalah pejuang yang mempertahankan
Kemerdekaan Republik Indonesia!)
Yang kedua karena kita katakan itu hak kita, maka
kalimat kedua, pemindahan kekuasaan diselenggarakan dalam tempo yang
sesingkat-singkatnya, kita bicara pemindahan, karena kemerdekaan itu hak kita,
kita tidak memerlukan persetujuan siapa-siapa, karena itu memang hak saya.
Karena itu kita tidak setuju dengan konsep serah terima kekuasaan. Disini saya
punya kesempatan diskusi panjang dengan Duta Besar Van Dam, kita mencoba
melihat kembali dengan penuh kematangan dan apresiasi kita terhadap sejarah,
kita sadari bahwa memang ada perbedaan-perbedaan, dengan refleksi penilaian
dengan sikap Belanda yang pada itu tidak menerima kemerdekaan Indonesia sebagai
bagian dari sejarah. Tetapi fakta bahwa kita bisa mendiskusikan hal tersebut
merupakan cermin dari kematangan diri kita.
(BRH:
Ben Bot pada 16 Agustus 2005 di Jakarta telah mengakui, bahwa . “… In retrospect, it is clear that its
large-scale deployment of military forces in 1947 put the Netherlands
on the wrong side of history. The fact that military action was taken and
that many people on both sides lost their lives or were wounded is a harsh and
bitter reality especially for you, the people of the Republic of Indonesia. A
large number of your people are estimated to have died as a result of the
action taken by the Netherlands. On behalf of the Dutch government, I
wish to express my profound regret for all that suffering…”)
Jadi dalam rangkaian perjuangan diplomasi itulah,
Linggajati telah memainkan peranan penting, saya tidak mengatakan bahwa
Linggarjati merupakan persetujuan yang memuaskan, karena memang kita tahu ada
penolakan, tapi Linggarjati setidaknya merupakan guliran pertama dari tiga
guliran penting yang menuju pada ujungnya pengakuan dan penghormatan Negara
Kesatuan Republik Indonesia di masyarakat Internasional.
(BRH:
Pernyataan yang sangat menyesatkan lagi. 1. Linggarjati, Renville dan KMB
adalah tonggak-tonggak penghapusan RI, 2. Hasil KMB, pemerintah Belanda BUKAN
MENGAKUI, melainkan “MEMINDAHKAN KEDAULATAN” –“SOEVEREINITEITSOVERDRACHT”
KEPADA REPUBLIK INDONESIA SERIKAT – RIS!, karena RIS dipandang sebagai
kelanjutan dari pemerintah Nederlands Indië, yang harus menanggung utang
pemerintah Nederlands Indië kepada pemerintah Belanda sebesar 4 ½ milyar
gulden, di mana di dalamnya termasuk biaya agresi militer 1 dan 2. RIS
dibubarkan pada 16 Agusus 1950. Tanggal 17 Agustus 1950 dinyatakan berdirinya
kembali NKRI berdasarkan proklamari 17 Agustus 1945 )
Hadirin yang saya hormati,
Di era globalisasi dan kemajuan teknologi informasi
sekarang ini, dengan interaksi antar-negara dan antar-masyarakat yang semakin
erat, dunia dan umat manusia masih dihadapkan pada berbagai konflik bersenjata.
Kekerasan dan kekuatan senjata masih menjadi pilihan dalam menyelesaikan
persoalan antar-manusia di berbagai belahan bumi.
Kita bersyukur bahwa di kawasan kita, selama 40 tahun
terakhir ini kita menikmati suasana damai, jika kita bandingkan dengan situasi
di belahan dunia lain, Palestina baru dua hari lalu, 18 korban meninggal akibat
serangan Israel, di Irak, tiap hari puluhan rakyat Irak meninggal karena
kekerasan. Tetapi bersyukur karena kawasan kita menikmati suasana damai. Dan
itu tidak datang dengan sendirinya, tetapi upaya diplomasi kita, salah satunya
adalah ASEAN, jadi diplomasi juga turut menyumbangkan upaya menciptakan
Indonesia yang aman, Indonesia yang damai, Asia Tenggara yang aman dan Asia
Tenggara yang damai, dan dengan begitu kita memiliki waktu dan energi untuk
kepentingan pembangunan ekonomi kita.
Karena itu kita berkepentingan untuk membantu
menyelesaikan konflik di negara lain, entah melalui upaya peacemaking, misalnya melalui membantu konflik kamboja, konflik di
Filipina selatan, kita mengirim pasukan-pasukan perdamaian, sekarang dalam
proses ke Lebanon, saya kira amanat konstitusi kita agar Indonesia ikut serta
dalam memelihara ketertiban dunia, world
order berdasarkan kemerdekaan, perdamaian abadi dan keadilan sosial,
merupakan amanat yang sangat penting, sebab dengan itu kita diamanatkan untuk
menjadi bangsa yang tidak egois, yang hanya memikirkan diri sendiri, tetapi
bangsa yang harus aktif , dalam upaya menciptakan perdamaian dunia.
Kita mungkin menganggap suatu kelumrahan apabila
konflik diselesaikan cara-cara damai, melalui perundingan, karena sesungguhnya
ini juga refleksi dari kecenderungan kita mungkin dapat dikatakan karakter kita
yang sangat mengedepankan dialog. Linggarjati merupakan simbol dari
kemampuan dan kemauan bangsa kita untuk menyelesaikan konflik melalui cara-cara
damai.
(BRG:
Perundingan Linggajati dan Renville hanyalah taktik Belanda untuk mengulur
waktu dalam rangka mempersiapkan agresi militernya secara besar-besaran
terhadap Republik Indonesia. Pada waktu yang bersamaan, Belanda memberlakukan
wajib militer di Belanda, dan kemudian mengirim 150.000 tentaranya ke
Indonesia, dibantu oleh 60.000 pribumi di Indonesia yang direkrut menjadi
serdadu KNIL dan sekitar 50.000 pasukan Po An TUI, yaitu pasukan bangsa Cina
yang tingal di Indonesia).
Kemampuan menciptakan perdamaian tersebut sangat
ditentukan oleh dua kekuatan bangsa, yaitu kekuatan moderasi dan kekuatan
dialog --- atau the force of moderation
and the force of dialogue.
Kekuatan moderasi adalah karakter alamiah kita sebagai
bangsa yang moderat. Moderasi bukanlah cara untuk mengalah. Justru kekuatan
moderasi adalah keyakinan akan kebenaran prinsip-prinsip yang kita anut, tanpa
harus menihilkan sikap toleransi terhadap prinsip dan kepentingan pihak lain.
Keberhasilan suatu proses perundingan sangat tergantung pada kekuatan moderat
di masing-masing pihak yang berunding.
Kekuatan dialog juga merupakan karakter bangsa kita,
yang tidak lain lahir dari kebhinekaan kita. Bagi kita sebagai negara yang sangat
pluralistik, sangat beragam, dialog merupakan bagian dari kehidupan kita
sehari-hari. salah satu dasar refleksi adalah filosofi kita yaitu musyawarah untuk mufakat. Kekuatan
dialog hanya bisa kita raih apabila secara sadar dan terus menerus kita pelihara
dan perkuat. Sejarah telah banyak mencatat bahwa dialog adalah kunci dari
penyelesaian konflik secara damai.
Karena itu saya menyambut baik pemikiran bapak Bupati
untuk mengembangkan dialog, mengembangkan cara-cara damai dalam menyelesaikan,
bukan menggunakan otot, tetapi menggunakan otak dan perasaan, sesuatu yang
memang bisa dilatih, sebab itu di Departemen luar negeri, bagi para calon
diplomat, terutama Diplomat Madya dan Senior, negosiasi merupakan suatu yang
kita ajarkan, banyak buku referensi mengenai itu, yang paling populer adalah “Getting to Yes”, bagaimana orang lain
mengiyakan apa yang kita mau, jadi bisa dipelajari, karena itu saya kira jika bapak mengembangkan dialog
sebagai suatu cara penyelesaian masalah dengan mengambil sampel kelompok pecinta sepak bola, satu hal yang kelihatannya
sederhana, tetapi saya melihat tidak sederhana, karena mempunyai makna penting
dalam membina karakter bangsa.
Berkaca pada perjalanan sejarah bangsa, maka kita
perlu terus memposisikan Indonesia sebagai kekuatan moderat dan kekuatan dialog
dalam politik internasional. Saya ingin menyebut, bagi kita dialog antar agama,
termasuk di Kabupaten Kuningan merupakan suatu keseharian, apapun persoalan
terjadi antar kehidupan beragama negara kita. Saat ini Departemen Luar Negeri
hampir secara berkala mengundang tokoh-tokoh agama untuk membahas berbagai
masalah-masalah, tidak hanya masalah masyarakat, tetapi juga masalah-masalah
dunia.
dan kita berdasarkan pengalaman kita, kita dorong,
kita ambil inisiatif untuk dialog dan kerjasama antar agama di Asia Pasifik,
bagi kita sepertinya mudah, tetapi tidak selalu demikian bagi orang lain,
ketika mereka menyambut dan ingin mengembangkan proses ini sebagai proses yang
berlanjut, karena itu pada bulan Juli kemarin diadakan dialog antar agama dan
budaya di Cebu, Filipina, diikuti oleh 20 negara Asia Pasifik, diambil
inisiatif dalam rangka kerjasama dengan negara Eropa (ASEM), diselenggarakan di
bali, dua tahun lalu, kemudian menjadi kegiatan yang melembaga, bulan Juli lalu
diadakan di Cyprus diadakan dialog ke dua , dan selanjutnya tahun depan akan
dilakukan di China, dan tahun 2008, di Belanda.
Bagi kita, hal tersebut merupakan hal sehari-hari,
tetapi bagi masyarakat internasional itu menjadi hal-hal yang luar biasa. Jadi
ada aset bangsa kita yang dapat menjadi aset kita dalam hubungan kita dengan
bangsa-bangsa lain, dan menarik, mereka ingin belajar, ketika Perdana Menteri
Tony Blair berkunjung di Indonesia, mereka mengusulkan untuk membentuk suatu
tim penasehat yang tokoh-tokoh agama kita, dengan tokoh-tokoh agama dari
Inggris dengan jumlah yang sama. Demikian juga di negeri Belanda mengajak kita
bekerjasama untuk mengadakan dialog, sebab dengan kehadiran jumlah komunitas
Islam yang berjumlah 1 juta, dari 16 juta penduduk Belanda, mereka ingin berbagi pengalaman bagaimana
mengelola pendidikan anak dalam keragaman agama.
Oleh karena itu sengaja saya sampaikan, hal
kelihatanya ringan seperti kebudayaan
kita yang mengedepankan dialog suatu hal yang punya nilai, karena itu penting
untuk kita mengunjungi linggarjati,
untuk mengenang bagaimana pemimpin kita di tengah situasi yang sulit berhasil
menghasilkan suatu kesepakatan, yang belum tentu memuaskan, tetapi menjadi
titik tolak dari perundingan selanjutnya.
Karena itu dari diplomasi indonesia kita
berkepentingan suara indonesia sebagai kekuatan moderat dan kekuatan dialog
akan makin berwibawa ketika kita sendiri dapat menyelesaikan konflik dalam
negeri melalui jalan damai, dan perundingan. Terus terang dengan kita berhasil
menyelesaikan masalah Aceh, dengan MoU yang ditandatangani 15 Agustus tahun
lalu, beberapa tetangga kita berkunjung dan ingin belajar bagaimana kita dapat
menyelesaikan masalah Aceh. Tidak kurang Perdana Menteri Thailand yang baru
berkunjung beberapa waktu yang lalu dengan terus terang kami mengakui bagaimana
anda menyelesaikan masalah Aceh selama 29 tahun secara damai. Ini merupakan tes bagi kita apakah pilkada di
Aceh akan berlangsung aman, damai dan demokratis, sehingga kita bicara mengenai
dialog, perdamaian, kita akan kredibel,
karena kita juga tunjukkan di dalam negara kita kita mampu menyelesaikan
masalah secara damai.
Saya juga menerima tamu Perdana Menteri Sri Lanka,
beberapa hari lalu, kunjungan Dubes Norwegia, karena dia menjadi penengah dalam
perundingan Macan Tamil dengan pemerintah Sri Lanka, kita diskusikan, berbagi
pengalaman bagaimana memecahkan masalah melalui perundingan. Kebetulan saya
menjadi penengah dalam perundingan Moro dengan Pemerintah Filipina yang
berujung pada perjanjian damai.
Dubes van Dam seperti saya juga pernah ditugaskan di
Kairo, dalam situasi yang sedikit berbeda. Saya beruntung bahwa dalam
pengalaman pertama penugasan diplomatik saya, saya dapat mengikuti dari dekat
proses Perundingan damai Mesir dengan Israel. Saya tiba di Kairo 12 November
1977, dari penugasan tersebut banyak memberikan inspirasi saya dalam melakukan
proses perdamaian yang tidak mudah, jangankan untuk perdamaian, orang yang
melakukan perdamaian saja bisa dimusuhi. Tidak kurang Presiden Sadat dibunuh adalah
karena dia mengadakan inisiatif dan menyelenggarakan proses damai. Kalau kita
melihat sejarah, disitu kita bisa menghargai bagaimana nilai, makna dari
pertemuan Linggarjati.
Saya kira saya berbicara cukup berkepanjangan, sekali
lagi saya menyampaikan penghargaan kepada Bupati Kuningan, kepada Panitia
Seminar ini, dan kepada seluruh hadirin.

Secara keseluruhan, pidato ini terkesan ingin
menyenangkan tamunya, yaitu Duta Besar Belanda, Nikolaos van Dam. Dalam
uraiannya, Wirajuda lebih menonjolkan versi Belanda, dan tidak memberikan
kesan, bahwa yang berbicara ini adalah Menteri Luar Negeri Republik Indonesia,
yang harusnya mempertahankan posisi Republik Indonesia dan mengangkat sisi
negatif Belanda dan membela keabsahan proklamasi 17.8.1945..
Padahal beberapa bulan sebelum pidato ini, tepatnya
pada 16 Agustus 2005, Menlu Belanda Ben Bot dalam pidatonya di gedung
Kementerian Luar Negeri di Jakarta telah mengakui terus terang, bahwa
pengerahan militer secara besar-besaran tahun 1947 telah menempatkan Belanda
pada sisi yang salah dari sejarah. Dia menyebut ‘militer’, dan bukan ‘polisi’.
Ben Bot mengatakan: “... In retrospect, it is clear that its large-scale
deployment of military forces in 1947 put
the Netherlands on the wrong side of history. The fact that military
action was taken and that many people on both sides lost their lives or were
wounded is a harsh and bitter reality especially for you, the people of the
Republic of Indonesia. A large number of your people are estimated to have died
as a result of the action taken by the Netherlands ...”
Wirajuda salah membaca peta politik dunia pada waktu
itu. Seusai Perang Dunia II, dunia internasional mengecam semua tindak kekerasan dan
pengerahan militer untuk menyelesaikan sengketa antar negara.
Pidato ini juga sangat sedikit memberi penjelasan
mengenai perundingan Linggarjati, yang mengakibatkan perpecahan di kalangan
Republik Indonesia. Banyak kalangan di pihak Republik Indonesia menuntut
PENGAKUAN KEMERDEKAAN 100% dari Belanda. Linggajati juga menjadi penyebab
jatuhnya Perdana Menteri RI, Sutan Syahrir, karena dipandang terlalu lunak
terhadap Belanda. Hasil perundingan Linggarjati merupakan kemenangan besar
Belanda, di mana Republik Indonesia mengakui kekuasaan Belanda di SELURUH
WILAYAH INDONESIA BAGIAN TIMUR, sedangkan Belanda hanya menerima de facto
Republik Indonesia atas Sumatera, Jawa dan Madura.
Kekalahan diplomasi di Linggajati ini berakibat fatal
untuk rakyat Indonesia di wilayah timur, terutama di Sulawesi dan Bali.
Persetujuan Linggajati memberikan “lampu hijau”kepada
Belanda untuk melakukan “pembersihan” terhadap kekuatan bersenjata pendukung
Republik Indonesia. Linggajati juga yang menyebabkan pembantaian ribuan rakyat
Indonesia di Sulawesi Selatan (setelah pemekaran, sebagian masuk wilayah
Provinsi Sulawesi Barat) dan tewasnya Kolonel I Gusti Ngurah Rai dalam
pertempuran Puputan Margarana.
Juga tidak ada kata-kata, bahwa Belanda kemudian
melanggar persetujuan Linggarjati dengan melancarkan agresi militer I.
Setelah agresi Belanda I, dilakukan perundingan
Renville, di mana kemudian de facto wilayah Republik Indonesia semakin
mengecil, yaitu hanya sebagian kecil Sumatera, dan sebagian kecil Jawa.
Agresi militer Belanda I diakhiri dengan perundingan
perdamaian di atas kapal perang AS Renville.
Satu hari setelah perundingan perdamaian Renville
dimulai, pada 9 Desember 1947 tentara Belanda membantai 431 penduduk sipil
di desa Rawagede, dekat Karawang.
Perundingan Renville juga suatu kemenangan besar untuk
Belanda, dimana Belanda “memperoleh” sebagian besar wilayah Republik Indonesia.
Kemudian Belanda mendirikan 15 “Negara dan daerah otonom”, a.l. Negara Sumatera
Timur, Negara Pasundan, Negara Jawa Timur, Negara Madura, dll., yang sebelum
perundingan Renville, adalah wilayah Republik Indonesia.
Belanda kemudian juga melanggar persetujuan Renville
dengan melancarkan agresi militer II.
Agresi militer II diakhiri dengan Konferensi Meja
Bundar – KMB di Belanda.
Ketika KMB dimulai, Belanda menghentikan semua siding
pengadilan kasus kejahatan perang yang dilakukan oleh tentara Belanda selama
agresi ke II. Namun di tengah perundingan perdamaian di Belanda dari 21 Agustus
– 2 November 1949, pada 5 September 1949 dilaksanakan hukuman mati terhadap
pejuang Indonesia, Robert Wolter Mongisidi.
Setelah Konferensi Meja Bundar – KMB, Republik
Indonesia hanya merupakan satu dari 16 negara Bagian dalam Republik Indonesia
Serikat-RIS. Selain harus menanggung utang pemerintah Nederlands Indië kepada
pemerintah Belanda sebesar 4 ½ milyar gulden sebagai hasil perundingan KMB,
juga Irian Barat tidak dimasukkan ke dalam RIS. Sebagai konsekuensi hasil KMB
ini, maka untuk pemerintah Belanda, Irian/Papua Barat bukanlah wilayah Republik
Indonesia.
Tahun 2000 pemerintah Belanda menugaskan pakar
sejarah,Prof. Drooglever untuk meneliti Penentuan Pendapat Rakyat – PEPERA,
yang adalah hasil keputusan PBB tahun 1969, yang memasukkan Papua Barat sebagai
bagian dari Republik Indonesia. Tahun 2005 Drooglever menerbitkan hasilnya
sebagai buku setebal lebih dari 700 halaman. Dengan satu kalimat dia
mengomentari, bahwa PEPERA adalah suatu penipuan besar. Yang menjadi pertanyaan
di sini, mengapa setelah 31 tahun Belanda mempermasalahkan lagi keputusan PBB
ini, di saat Indonesia sedang menghadapi
konflik dengan Organisasi Papua Merdeka –OPM.
KMB juga membentuk Uni Belanda-Indonesia dengan Ratu
Belanda sebagai Kepala Uni. Untuk hubungan internasional, RIS harus “meminta
izin” dari Belanda.
Tahun 1956, pemerintah Republik Indonesia secara
sepihak membatalkan hasil KMB. Namun 4 milyar gulden telah dibayar ke Belanda
sebagai hasil KMB.
Dalam pidatonya Wirajuda mengeluhkan kurang
penghargaan bangsa terhadap peran diplomasi. Dia mengatakan: “… Terus terang dari
penelitian saya, khususnya pada periode sejarah ‘45-‘50 ini, saya melihat
kurangnya apresiasi atau penghargaan bangsa terhadap peran diplomasi…”
Melihat hasil perundingan Linggarjati, Renville dan
KMB, tidaklah mengherankan, bahwa di kalangan pejuang Republik Indonesia, peran
diplomasi dinilai gagal!
Belanda sendiri saat ini sedang berusaha menghapus
lembaran hitam dalam sejarah Belanda, terutama periode 1945 – 1950. Dan untuk
periode penjajahan di masa VOC, yang ditonjolkan hanya sisi manisnya saja,
dengan mengglorifikasi zaman VOC sebagai zaman keemasan – de gouden Eeuw.

MONTEVIDEO CONVENTION
ON RIGHTS AND DUTIES OF STATES
Agreement signed at Montevideo, Uruguay, on
December 26, 1933 (and entering into force the following year), that
established the standard definition of a state
under international law. Adopted by the Seventh
International Conference of American States, the convention stipulated that all
states were equal sovereign units consisting of a permanent population, defined
territorial boundaries, a government, and an ability to enter into agreements
with other states. Among the convention’s provisions were that signatories
would not intervene in the domestic or foreign affairs of another state, that they would
not recognize territorial gains made by force, and that all disputes should be
settled peacefully. The agreement was signed by the United States, Argentina, Brazil, Chile, Colombia,
Cuba, the Dominican Republic, Ecuador, El Salvador, Guatemala, Haiti, Honduras, Mexico,
Nicaragua, Panama, Paraguay, Peru, Uruguay, and Venezuela. Bolivia was the only
country attending the conference that refused to sign the agreement.
The state as a person of international law
should possess the following qualifications: a ) a permanent population; b ) a
defined territory; c ) government; and d) capacity to enter into relations with
the other states.
The federal state shall constitute a sole
person in the eyes of international law.
The political existence of the state is
independent of recognition by the other states. Even before recognition the
state has the right to defend its integrity and independence, to provide for
its conservation and prosperity, and consequently to organize itself as it sees
fit, to legislate upon its interests, administer its services, and to define
the jurisdiction and competence of its courts.
The exercise of these rights has no other limitation
than the exercise of the rights of other states according to international law.
States are juridically equal, enjoy the same
rights, and have equal capacity in their exercise. The rights of each one do
not depend upon the power which it possesses to assure its exercise, but upon
the simple fact of its existence as a person under international law.
The fundamental rights of states are not
susceptible of being affected in any manner whatsoever.
The recognition of a state merely signifies
that the state which recognizes it accepts the personality of the other with
all the rights and duties determined by international law. Recognition is
unconditional and irrevocable.
The recognition of a state may be express or
tacit. The latter results from any act which implies the intention of
recognizing the new state.
No state has the right to intervene in the
internal or external affairs of another.
The jurisdiction of states within the limits of
national territory applies to all the inhabitants.
Nationals and foreigners are under the same
protection of the law and the national authorities and the foreigners may not
claim rights other or more extensive than those of the nationals.
The primary interest of states is the
conservation of peace. Differences of any nature which arise between them
should be settled by recognized pacific methods.
The contracting states definitely establish
as the rule of their conduct the precise obligation not to recognize
territorial acquisitions or special advantages which have been obtained by
force whether this consists in the employment of arms, in threatening
diplomatic representations, or in any other effective coercive measure. The territory
of a state is inviolable and may not be the object of military occupation nor
of other measures of force imposed by another state directly or indirectly or
for any motive whatever even temporarily.
The present Convention shall not affect
obligations previously entered into by the High Contracting Parties by virtue
of international agreements.
The present Convention shall be ratified by
the High Contracting Parties in conformity with their respective constitutional
procedures. The Minister of Foreign Affairs of the Republic of Uruguay shall
transmit authentic certified copies to the governments for the aforementioned
purpose of ratification. The instrument of ratification shall be deposited in
the archives of the Pan American Union in Washington, which shall notify the
signatory governments of said deposit. Such notification shall be considered as
an exchange of ratifications.
The present Convention will enter into force
between the High Contracting Parties in the order in which they deposit their
respective ratifications.
The present Convention shall remain in force
indefinitely but may be denounced by means of one year's notice given to the
Pan American Union, which shall transmit it to the other signatory governments.
After the expiration of this period the Convention shall cease in its effects
as regards the party which denounces but shall remain in effect for the
remaining High Contracting Parties.
The present Convention shall be open for the
adherence and accession of the States which are not signatories. The
corresponding instruments shall be deposited in the archives of the Pan
American Union which shall communicate them to the other High Contracting
Parties.
In witness whereof, the following
Plenipotentiaries have signed this Convention in Spanish, English, Portuguese
and French and hereunto affix their respective seals in the city of Montevideo,

I.
Open covenants of peace, openly
arrived at, after which there shall be no private international understandings
of any kind but diplomacy shall proceed always frankly and in the public view.
II.
Absolute freedom of navigation upon
the seas, outside territorial waters, alike in peace and in war, except as the
seas may be closed in whole or in part by international action for the
enforcement of international covenants.
III.
The removal, so far as possible, of
all economic barriers and the establishment of an equality of trade conditions
among all the nations consenting to the peace and associating themselves for
its maintenance.
IV.
Adequate guarantees given and taken
that national armaments will be reduced to the lowest point consistent with
domestic safety.
V.
A free, open-minded, and absolutely
impartial adjustment of all colonial claims, based upon a strict observance of
the principle that in determining all such questions of sovereignty the
interests of the populations concerned must have equal weight with the
equitable claims of the government whose title is to be determined.
VI.
The evacuation of all Russian
territory and such a settlement of all questions affecting Russia as will
secure the best and freest cooperation of the other nations of the world in
obtaining for her an unhampered and unembarrassed opportunity for the
independent determination of her own political development and national policy
and assure her of a sincere welcome into the society of free nations under
institutions of her own choosing; and, more than a welcome, assistance also of
every kind that she may need and may herself desire. The treatment accorded Russia
by her sister nations in the months to come will be the acid test of their good
will, of their comprehension of her needs as distinguished from their own
interests, and of their intelligent and unselfish sympathy.
VII.
Belgium, the whole world will agree,
must be evacuated and restored, without any attempt to limit the sovereignty
which she enjoys in common with all other free nations. No other single act
will serve as this will serve to restore confidence among the nations in the
laws which they have themselves set and determined for the government of their
relations with one another. Without this healing act the whole structure and
validity of international law is forever impaired.
VIII.
All French territory should be freed
and the invaded portions restored, and the wrong done to France by Prussia in
1871 in the matter of Alsace-Lorraine, which has unsettled the peace of the
world for nearly fifty years, should be righted, in order that peace may once
more be made secure in the interest of all.
IX.
A readjustment of the frontiers of Italy should
be effected along clearly recognizable lines of nationality.
X.
The peoples of Austria-Hungary, whose
place among the nations we wish to see safeguarded and assured, should be
accorded the freest opportunity to autonomous development.
XI.
Rumania, Serbia, and Montenegro should
be evacuated; occupied territories restored; Serbia accorded free and secure
access to the sea; and the relations of the several Balkan states to one
another determined by friendly counsel along historically established lines of
allegiance and nationality; and international guarantees of the political and
economic independence and territorial integrity of the several Balkan states
should be entered into.
XII.
The Turkish portion of the present
Ottoman Empire should be assured a secure sovereignty, but the other
nationalities which are now under Turkish rule should be assured an undoubted
security of life and an absolutely unmolested opportunity of autonomous
development, and the Dardanelles should be permanently opened as a free passage
to the ships and commerce of all nations under international guarantees.
XIII.
An independent Polish state should be
erected which should include the territories inhabited by indisputably Polish
populations, which should be assured a free and secure access to the sea, and
whose political and economic independence and territorial integrity should be
guaranteed by international covenant.
XIV. A
general association of nations must be formed under specific covenants for the
purpose of affording mutual guarantees of political independence and
territorial integrity to great and small states alike.

The President of the United States of
America and the Prime Minister, Mr. Churchill, representing His Majesty's
Government in the United Kingdom, being met together, deem it right to make
known certain common principles in the national policies of their respective
countries on which they base their hopes for a better future for the world.
First, their countries seek no aggrandizement,
territorial or other;
Second, they desire to see no territorial changes that do
not accord with the freely expressed wishes of the peoples concerned;
Third, they respect the right of all peoples to choose
the form of government under which they will live; and they wish to see
sovereign rights and self government restored to those who have been forcibly
deprived of them;
Fourth, they will endeavor, with due respect for their
existing obligations, to further the enjoyment by all States, great or small,
victor or vanquished, of access, on equal terms, to the trade and to the raw
materials of the world which are needed for their economic prosperity;
Fifth, they desire to bring about the fullest
collaboration between all nations in the economic field with the object of
securing, for all, improved labor standards, economic advancement and social
security;
Sixth, after the final destruction of the Nazi tyranny,
they hope to see established a peace which will afford to all nations the means
of dwelling in safety within their own boundaries, and which will afford
assurance that all the men in all lands may live out their lives in freedom

Seventh, such a peace should enable all men to traverse
the high seas and oceans without hindrance;
Eighth, they believe that all of the nations of the
world, for realistic as well as spiritual reasons must come to the abandonment
of the use of force. Since no future peace can be maintained if land, sea or
air armaments continue to be employed by nations which threaten, or may
threaten, aggression outside of their frontiers, they believe, pending the
establishment of a wider and permanent system of general security, that the
disarmament of such nations is essential. They will likewise aid and encourage
all other practicable measure which will lighten for peace-loving peoples the

on 7 December 1942
Today
it is a year ago that the Japanese, without previous declaration of war,
launched their treacherous attack on our Allies. At that time we did not
hesitate for a moment to throw ourselves into the struggle and to hasten to the
aid of our Allies, whose cause is ours.
Japan
had been preparing for this war and for the conquest of the Netherlands Indies
for years and in so doing sought to follow the conduct of its Axis partners in
attacking one country after another. This plan we were able to prevent, thanks
to our immediate declaration of war. After a year of war we can bear witness
that the tide is turning and that the attacker, who had such great advantages,
is being forced on the defensive.
It
is true that the Netherlands Indies,
after defending themselves so heroically are, for the most part,
occupied by the enemy, but this phase of the struggle is only a prelude.
The Japanese are getting ever nearer the limit of their possibilities as our
ever-growing might advance towards them from all sides. They have not been able
to break China's courage and endurance and Japan now faces the ebbing of her
power in this self-willed war, which will end with her complete downfall.
At
this moment my thoughts are more than ever with my country and my compatriots
in the Netherlands and the Netherlands Indies. After an age-old historical solidarity, in which had
long since passed the era of colonial relationship, we stood on the eve of a collaboration on a basis of equality
when suddenly we were both confronted by the present ordeal. The
treacherous aggression on the Netherlands in 1940 was the first interruption in
the process of development; the heroic
battle of the Netherlands Indies, followed by the occupation of the major
part of this territory in 1942, was the second.
At
the time when the Indies were still free and only Holland was occupied, the
vigor of our unity became apparent and on both sides a feeling of stronger
kinship developed more rapidly than it could have in peacetime. Now, however,
this mutual understanding has been deepened still further because the same
struggle is shared in all its agony and the same distress is suffered in all
its bitterness. In the Netherlands as well as in the Netherlands Indies the
enemy, with his propaganda for the so-called new order, has left nothing
untried to lure the spirit of the people and to disguise his tyranny and
suppression with the lies of his promises for the future. But these lies and
this deceit have been of no avail because nearly all have seen through them and
have understood that our enemies have as
their aim nothing but slavery and exploitation and that as long as they
have not been driven out and defeated there can be no question of freedom.
In
previous addresses I announced that it is my intention, after the liberation,
to create the occasion for a joint consultation about the structure of the
Kingdom and its parts in order to adapt it to the changed circumstances. The
conferences of the entire Kingdom which will be convoked for this purpose, has
been further outlined in a Government declaration of January 27th, 1942. The preparation of this conference, in
which prominent representatives of the three overseas parts of the Kingdom
will be united with those of the Netherlands at a round table, had already
begun in the Netherlands Indies, Surinam and Curacao, the parts of the
Kingdom which then still enjoyed their freedom. Especially in the
Netherlands Indies, detailed material had been collected for this purpose and
it was transmitted to me in December 1941 by the Governor-General. The battle
of the Netherlands Indies disrupted these promising preparations.
We
can only resume these preparations when everyone will be able to speak his mind
freely. Although it is beyond doubt that a political reconstruction of the
Kingdom as a whole and of the Netherlands and the overseas territories as its
parts is a natural evolution, it would be neither right nor possible to define
its precise form at this moment. I realize that much which is great and good is
growing in the Netherlands despite the pressure of the occupation; I know that
this is the case in the Indies where our unity is fortified by common
suffering. These developing ideas can only be shaped in free consultation in
which both parts of the Kingdom will want to take cognizance of each other's
opinions. Moreover, the population of the Netherlands and of the Netherlands
Indies has confirmed, through its suffering and its resistance, its right to
participate in the decision regarding the form of our responsibility as a
nation towards the world and of the various groups of the population towards
themselves and one another.
By
working out these matters now, that right would be neglected, and the insight
which my people have obtained through bitter experience, would be disregarded.
I
am convinced, and history as well as reports from the occupied territories
confirm me in this, that after the war it will be possible to reconstruct the
Kingdom on the solid foundation of complete partnership, which will mean the
consummation of all that has been developed in the past. I know that no
political unity nor national cohesion can continue to exist which are not
supported by the voluntary acceptance and the faith of the great majority of
the citizenry. I know that the
Netherlands more than ever feel their responsibility for the vigorous growth of
the Overseas Territories and that the
Indonesians recognize, in the ever-increasing collaboration, the best guarantee for the recovery of
their peace and happiness. The war
years have proved that both peoples possess the will and the ability for
harmonious and voluntary cooperation.
A
political unity which rests on this foundation moves far towards a realization
of the purpose for which the United Nations are fighting, as it has been
embodied, for instance, in the
Atlantic Charter, and with which we could instantly agree, because it contains our own conception of
freedom and justice for which we have sacrified blood and possessions in
the course of our history. I visualize, without anticipating the
recommendations of the future conference, that they will be directed towards a
commonwealth in which the Netherlands. Indonesia,
Surinam and Curacao will participate, with complete
self-reliance and freedom of conduct for each part regarding its internal
affairs, but with the readiness to render mutual assistance.
It
is my opinion that such a combination of independence and collaboration can
give the Kingdom and its parts the strength to carry fully their
responsibility, both internally and externally. This would leave no room for
discrimination according to race or nationality; only the ability of the
individual citizens and the needs of the various groups of the population will
determine the policy of the government.
In
the Indies, as in the Netherlands, there now rules an oppressor who, imitating
his detestable associates and repudiating principles which he himself has
recognized in the past, interns peaceful citizens and deprives women and
children of their livelihood. He has uprooted and dislocated that beautiful and
tranquil country; his new order brings nothing but misery and want.
Nevertheless, we can aver that he has not succeeded in subjugating us, and as
the ever-growing force of the United Nations advances upon him from every
direction, we know that he will not succeed in the future.
The
Netherlands Indies and the Netherlands with their fighting men on land, at sea
and in the air, with their alert and brave merchantmen and by their dogged and
never-failing resistance in the hard struggle, will see their self-sacrifice
and intrepidity crowned after the common victory with the recovery of peace and
happiness for their country and their people in a new world. In that regained
freedom they will be able to build a new and better future.

WE THE PEOPLES OF THE UNITED NATIONS DETERMINED
to save succeeding
generations from the scourge of war, which twice in our lifetime has brought
untold sorrow to mankind, and
to reaffirm faith in
fundamental human rights, in the dignity and worth of the human person, in the
equal rights of men and women and of nations large and small, and
to establish conditions
under which justice and respect for the obligations arising from treaties and
other sources of international law can be maintained, and to promote social
progress and better standards of life in larger freedom,
AND FOR THESE ENDS
to practice tolerance
and live together in peace with one another as good neighbours, and to unite
our strength to maintain international peace and security, and
to ensure, by the
acceptance of principles and the institution of methods, that armed force shall
not be used, save in the common interest, and
to employ international
machinery for the promotion of the economic and social advancement of all
peoples,
HAVE RESOLVED TO COMBINE OUR EFFORTS TO ACCOMPLISH THESE
AIMS
Accordingly, our
respective Governments, through representatives assembled in the city of San
Francisco, who have exhibited their full powers found to be in good and due
form, have agreed to the present Charter of the United Nations and do hereby
establish an international organization to be known as the United Nations.
CHAPTER I: PRINCIPLES
AND PURPOSES
Article
1
The Purposes of the
United Nations are:
1.
To maintain international peace and
security, and to that end: to take effective collective measures for the
prevention and removal of threats to the peace, and for the suppression of acts
of aggression or other breaches of the peace, and to bring about by peaceful
means, and in conformity with the principles of justice and international law,
adjustment or settlement of international disputes or situations which might
lead to a breach of the peace;
2. To develop friendly relations among
nations based on respect for the principle of equal rights and
self-determination of peoples, and to take other appropriate measures to
strengthen universal peace;
3.
To achieve international co-operation
in solving international problems of an economic, social, cultural, or
humanitarian character, and in promoting and encouraging respect for human
rights and for fundamental freedoms for all without distinction as to race,
sex, language, or religion; and
4.
To be a centre for harmonizing the
actions of nations in the attainment of these common ends.
Article
2
The Organization and its
Members, in pursuit of the Purposes stated in Article 1, shall act in
accordance with the following Principles.
1.
The Organization is based on the
principle of the sovereign equality of all its Members.
2.
All Members, in order to ensure to all
of them the rights and benefits resulting from membership, shall fulfil in good
faith the obligations assumed by them in accordance with the present Charter.
3.
All Members shall settle their
international disputes by peaceful means in such a manner that international
peace and security, and justice, are not endangered.
4.
All Members shall refrain in their
international relations from the threat or use of force against the territorial
integrity or political independence of any state, or in any other manner
inconsistent with the Purposes of the United Nations.
5.
All Members shall give the United
Nations every assistance in any action it takes in accordance with the present
Charter, and shall refrain from giving assistance to any state against which
the United Nations is taking preventive or enforcement action.
6.
The Organization shall ensure that
states which are not Members of the United Nations act in accordance with these
Principles so far as may be necessary for the maintenance of international
peace and security.
7.
Nothing contained in the present
Charter shall authorize the United Nations to intervene in matters which are
essentially within the domestic jurisdiction of any state or shall require the
Members to submit such matters to settlement under the present Charter; but
this principle shall not prejudice the application of enforcement measures
under Chapter VII.

The Security Council.
Recalling its
resolutions 27 (1947) of 1 August, 30 (1947) and 31 (1947) of 25 August and 36
(1947) of 1 November 1947,
with respect to the Indonesian Question,
Taking note with
approval of the reports submitted to the Security Council by its Committee
of Good Offices for Indonesia,
Considering that its
resolutions 63 (1948) and 64 (1948) of 24 and 28 December 1948 have not been
fully carried out,
Considering that
continued occupation of the territory of the Republic Indonesia by the armed
forces of the Netherlands
is imcompatible with the restoration of good relations between the parties and
with the final achievement of a just and lasting settlement of the Indonesian
dispute,
Cosidering that the
establishment and maintenance of the law and order throughout Indonesia is a necessary condition
to achievement of the expressed objectives and desires of booth parties,
Noting with satisfaction
that the parties continue to adhere to the principles of the Renville Agreement
and agree that free and democratic elections should be held throughout
Indonesia for purpose of establishing a constituent assembly at the earliest
praticable date, and further agree that the Security Council should arrange for
the observation of such elections by an appropriate agency of the United
Nations; and that the representative of the Netherlands has expressed his
Government’s desire to have such elections held not later than 1 October 1949,
Noting also with
satisfaction that the Government of the Netherlands plans to transfer
sovereignity to the United States of Indonesia by 1 January 1950 if possible and any case during
the Year 1950,
Consciuos of its
primary responsibility for the maintenance of international peace and security,
and in order that the rights, claims and positions of the parties may not
prejudices by the use of force,
1.
Calls upon
the Government of the
Netherlands to
ensure the immediate
discontinuance of all military operations, calls
upon the Government of the Republic simultanously to order its armed adherents
to cease guerilla warfare, and calls upon booth parties to cooperate in the
restoration of peace and the maintenace of law and order throughout the area
affected;
2.
Calls upon
the Government of
the Netherlands to
release immediately and
unconditionally all political prisoners arrested by
it since 19 December 1948 in the Republic of Indonesia, and to facilitate the
immediate return of officials of the Government of the Republic Indonesia to
Jogjakarta in order that they may
discharge their responsibilities under paragraph 1 above and exercize their
appropriate functions in full freedom, including administration of the
Jogjakarta area, which shall include the city of Jogjakarta and its immedate environs.
The Netherlands authorities
shall afford to the Government of the Republic
of Indonesia such facilities as may
reasonably be required by the Government for its effective functioning and
consultation with all persons in Indonesia;
3.
Recommends that, in the interrest of carrying out
the expressed objectives
and
desires of both parties to establish of
federal,independent and sovereign United States of Indonesia at the earliest
possible date, negotiations be undertaken as soon as possible by representatives
of the Government of the Netherlands and representatives of Republic of
Indonesia, with the assistance of the commission reffered to in paragraph 4
below, on the basis of the principles set forth in the Linggardjati
and Renvile Agreements, and taking advantage of the extent of agreement reached
between the parties regarding the proposals submitted to them by representative
of the United States of America on the committee of Good Offices on September
1948,
and in particular, on the basis that :
(a) The establishment of the interim federal
government which is to be granted the powers of internal government in
Indonesia during the interim period before the tranfer of sovereignity shall be
result of the above negotiations and shall take place not later than 15 March
1949;
(b)
The elections which
are to be
held for the
purpose of choosing
representatives to an
Indonesian constituent assembly
should be completed
by
1 October 1949;
(c)
The transfer of
sovereignity over Indonesia by the Government of the
Netherlands to the United States of
Indonesia should take place at the earliest
possible date any case not later
than 1 July 1950;
provided that, if no agreement is reached by one
month prior to the respective dates referred to in sub-paragraphs (a),(b), and
(c) above,the Commission referred to in paragraph 4 (a) below, or such other
United Nations agency as may be established in accordance to the Security
Council with its recommendation for a solution of the difficulties;
4.
Resolves that :
(a) The
Commttee of Good Offices
shall henceforth be
known as the
United
Nations Commission for Indonesia. The Commission shall act
as the
representative of the Security Council in Indonesia
and shall have all of the
functions assigned to the Committee of Good
Offices by the Security Council
since 18 December 1948 and the functions conferred on it by the terms of this
resolution. The Commission shall act by
majority and minority views if there is a
difference of opinion among the members of
Commission.
(b) The
Consular Commission is
requested to facilitate
the work of
the United
Nations Commission for Indonesia by providing military
observers and other staff
and facilities to enable the Commission to
carry out its duties under the Council’s
resolutions 63 (1948) and 65 (1948) of 24 and
28 December 1948 as well as
under the present resolution, and shall
temporarily suspend other activities;
(c) The
Commission shall assist the parties in the
implementation of this resolution
and in the negotiations to be undertaken under
paragraph 3 above and is
authorized to make recommendations to them or to the Security
Council on
matters within the competence. Upon agreement
being reached in such
negotiations, the Commission shall make
recommendation of the provisions of
such agreement until sovereignity is
transferred by the Government of the
Netherlands
to the United States of Indonesia;
(d) The
Commission shall have authority to
consult with representatives of areas in
Indonesia other than the Republic,
and to invite representatives of such areas to
participate in the negotiations referred to in
paragraph 3 above;
(e) The
Commission, or such other United Nations agency as may be established in
accordance
with its recommendation under paragraph 4 (c)
above, is authorized
to
observe on behalf of the United Nations the elections to be held throughout
Indonesia
and is further authorized, in respect of the territories of Java, Madura
and Sumatra, to make recommendations regarding the conditions
necessary (a)
to ensure
that the elections are free and democratic, (b) to guarantee freedom of
assembly,
speech and publication at all times,provided that such guarantee is not
contrued
so as to include advocacy of violence or reprisals;
(f)
The Commission should assist in achieving the
earliest possible restoration of the
civil administration of
the Republic. To this end it shall, after consultation with the parties,
recommend the extent to which, consistent with reasonable requirements of
public security and the protection of life and property, areas controlled by of
progressively returned to the administration of the Government of the Republic of Indonesia, and shall supervise such transfers.
The recommendations of the Commission may include provision for such economic
measures as are required for the proper functioning of the administration and
for the economic well-being of the population of the areas involved in such
transfers. The Commission shall, after consultation with the parties, recommend
wich, if any, Netherlands forces shall be retained temporarily in any area
(outside of Jogjakarta area) in order to assist in the maintenance of law and
order. If either of the parties fails to accept the recommendations of the
Commission mentioned in this paragraph, the Commission shall report immediately
to the Security Council with its further recommendations for a solution of the
difficulties;
(g) The
Commission shall render periodic reports to the Council, and special reports
whenever the Commission deems necessary;
5.
Request
the Secretary-General to
make available to
the Commission such
staff, funds and other facilities as area required
by the Commission for the dischage of its functions;
6.
Calls upon the Government of the Netherlands and the Republic of Indonesia to
co-operate fully in giving effect to the provisions
of this resolution.
Adopted at the 406 meeting
Decissions
At its 410 meeting, on 16 February 1949, the
Council accepted the recommendation of the United Nations Commission for Indonesia
(S/1258) that
the the submission of its initial report under Council resolution 67 (1949)
should be postponed until 1
March 1949.
At its 410 meeting, on 11 March 1949, the Council
decided to invite the representative of Pakistan to participate, without
vote, in the dicussion of the question.

Wirajuda: Bagusnya Menlu dari Kalangan Profesional
Jakarta - Presiden Joko Widodo (Jokowi) dan
Wakil Presiden Jusuf Kalla (JK) sedang pempersiapkan susunan kabinet yang akan
menempati posisi menteri untuk 5 tahun ke depan. Lalu, bagaimana pandangan
Mantan Menteri Luar Negeri RI, Hassan Wirajuda, terkait posisi Menteri Luar
Negeri Jokowi?
"Saya juga belum tahu siapa," kata Hassan usai menjadi pembicara
dalam diskusi yang diprakarsai Human Right Working Goverment (HRWG) bertajuk
'The Future of Human Rights in Asean Community: Opportunies and Challanges' di
Auditorium CSIS Jalan Tanah Abang III No 23-27, Jakarta Pusat, Jumat
(24/10/2014). Menurut Menlu yang menjabat sejak tahun 2001 sampai 2009 ini,
orang yang cocok menjabat Menlu Jokowi adalah dari kalangan profesional.
"Menurut saya pribadi, bagus kalau Menlunya orang karir,
profesional," kata
Hassan sendiri tidak menjawab gamblang mana yang lebih cocok menjadi Menlu
saat disodorkan dua nama yang saat ini sedang menguat, yaitu Dirjen Asia
Pasifik dan Afrika Menlu, Yuri Octavian Thamrin dan Dubes RI untuk Belanda,
Retno LP Marsudi.
Kendati begitu, Menlu pada era Presiden Megawati Sookarnoputri dan Susilo
Bambang Yudhoyono itu menyebut bahwa keduanya adalah orang-orang terbaik. "Itu
orang-orang terbaik saya," ujarnya.
Sebelumnya, Selama dua hari terakhir, Dirjen Asia Pasifik dan Afrika
Kementerian Luar Negeri Yuri Octavian Thamrin terlihat mendampingi Presiden
Joko Widodo (Jokowi). Yuri atau Retno, Menlu pilihan Jokowi?
Yuri memang salah satu orang dari dalam Kemlu yang disebut-sebut sebagai calon
kuat Menlu. Selain Yuri, ada nama-nama lain seperti Retno LP Marsudi, Desra
Percaya, Djauhari Oratmangun, dan Havaz Oegroseno.
Nah, Yuri pada Senin (20/10) malam dan Selasa (21/10), terlihat berada di dekat
Jokowi di Istana Merdeka. Pria yang pernah menjadi jubir Kemlu dan Pewakilan
Tetap RI di Jenewa yang selalu tampil rapi itu menemani Presiden Jokowi saat
menerima beberapa tamu negara.
